Mr. Mitsunaga is a founding partner of Johns Monroe Mitsunaga Koloušková PLLC, a law firm in Bellevue, Washington. He has over 28 years of experience representing private and public clients in land use and real estate development, transactions and advice, construction and capital projects, and civil litigation.
Land Use and Real Estate
Mr. Mitsunaga represents clients in all phases of land use and real estate development, including environmental review and related litigation. He has substantial experience in advising clients and drafting documents for real estate transactions, and reviewing and negotiating contracts and leases. He also has considerable experience in administrative proceedings appearing before local and state agencies to obtain permits and approvals necessary for land development and construction projects. In this context, Mr. Mitsunaga has consulted with other professionals and clients to prepare permit applications, negotiated with agencies and represented clients at public hearings before hearing examiners, city and county councils, and other public boards and agencies. He has also litigated numerous judicial challenges to land use approvals, appearing before both the trial and appellate courts of Washington.
Representative clients include local government entities, financial institutions, developers, and property owners.
Mr. Mitsunaga represents owners, developers, and public agencies in the construction industry. He prepares, negotiates and helps administer all aspects of contracts, including impact, delay and other contractual disputes. He also handles public bidding claims and lien resolution, including foreclosure and defense. Mr. Mitsunaga has particular expertise in construction litigation and has spent significant time pursing and defending complex construction disputes.
Public Agency Law
Darrell represents the Northshore School District and other public agencies in contract preparation, negotiation, and administration of construction projects, including preparation of AIA customized general contractor, general conditions, lump sum, general contractor as construction manager, owner/architect, and bid forms. He also advises public agencies on related topics including bid protest analysis and defense, risk exposure analysis, and construction change directive/change order delay, impacts. In the course of this representation, Mr. Mitsunaga has represented clients in litigation, arbitration, and mediation of construction defect and lien claims as well as other disputes arising from construction projects of all kinds.
Mr. Mitsunaga has substantial jury and non-jury trial experience in the trial courts of Washington and has argued cases before the Washington State Supreme Court and Court of Appeals. He has also represented clients in numerous mediations and arbitrations. He has substantial experience handling complex and multi-party litigation in a responsive, creative, and cost-effective manner.
Darrell has represented a variety of business and individual clients in commercial and real estate-related litigation/trials involving purchase and sale agreements, commercial leases, development financing, real property claims, construction claims, owner/contractor claims, contract disputes, and architectural and engineering design.
