Land Development: Project Feasibility Review

One of the most critical and, unfortunately, often overlooked aspects of owning, acquiring and developing property is a thorough feasibility review before purchasing it.

Our attorneys are familiar with the many layers of land development statutes, codes and regulations enforced by local, state and federal agencies.  In addition, we routinely process the permits and approvals public regulators and utilities require for residential and commercial developments.  Based on this experience, we can provide expert feasibility review of potential projects.  As part of this review, we determine the uses that are possible on a parcel of property, and identify the permits the various jurisdictions will require as well as the potential problems a property owner may encounter during the review process.  We also assist our clients in identifying potential problems and pitfalls during the permit process and estimating the amount of time that will be required to complete the permit review processes.

In most cases, our participation in the feasibility review process is as a member of the client’s project team of architects, engineers (civil, traffic etc), and environmental consultants.  Given the complexity of the land development regulatory scheme, a multi-disciplinary approach to feasibility review is essential.  Our goal is to assist clients in making informed decisions about property acquisition, permit requirements and timing.  In addition, by participating in the feasibility review process, we are often able to provide guidance on project designs and alternatives that will increase the likelihood that financially viable projects will be approved.
